I have over 36 years experience of working in a legal environment, whether that be Local Government or Private Practice. My career has covered a broad legal spectrum, that includes civil litigation, insolvency, bankruptcy, Landlord and Tenant and Regulation and Registration matters.
In 2002 I was a Senior Legal Adviser for the National Care Standards Commission ( now known as the Care Quality Commission) and have spent the last 18 years working with one of the countries largest independent healthcare providers. Since 2007 my interest and focus has been on the Mental Capacity Act 2005, Deprivation of Liberty Safeguards and Lasting Powers of Attorney, that apply in England and Wales.
Jersey and the Isle of Man have their own mental capacity laws, the Capacity and Self Determination Law in Jersey and now the Capacity Bill that has finally arrived in the Isle of Man.
My business concept is to give you the necessary knowledge and understanding of the legal framework that surrounds Lasting Powers of Attorney and how to successfully apply and register your own Lasting Power of Attorney.You will understand the 2 types of Power ( Health & Welfare; Financial) and I will guide you through to achieve successful register of these critical legal documents.
Despite Powers of Attorney being available since 2007 there are still only 5 million people that have registered their Powers, meaning that often when someone loses the mental capacity to make their own decisions, family and friends are often at a loss as to how to decide how to act in someone’s best interests. This can often mean that during what is already a heartbreaking and stressful time, Bank Accounts are being frozen or family and friends are in disagreement as to what they think is in “Julie’s best interests”. By creating Powers of Attorney, whilst you have the capacity to do so, you remove a lot of the uncertainty about your future decision making and you are taking control and getting your own affairs in order.
People are often reluctant to apply for Powers of Attorney either because if means confronting difficult decisions you will have to make or, the process and cost of applying for Powers of Attorney can be off putting.

I was the first regional legal adviser to join the National Care Standards Commission ( now the Care Quality Commission) in April 2002. They remain the Regulatory Body for health and social care provision in England. For 18 years I was the Regulation Manager for one of the largest independent healthcare providers in the United Kingdom, and gave registration and regulatory advice to those homes to ensure successful registration of that service b) continued compliance with Regulations and c) Support in challenging inspection reports or enforcement by the Regulator.
I can assist across all regulatory domains in the United Kingdom having had vast experience of the English, Welsh, Scottish, Isle of Man and Jersey regulatory regimes.
The Mental Capacity Act 2005 arrived in 2007, and was followed 2 years later by the Deprivation of Liberty Safeguards. Both serve to ensure that the individual is front and centre of all decision making and if that person is no longer capable of making their own decisions, whether is it about their health and welfare or finances, or where to live, then these legal frameworks offer protection and empowerment.
I can help your organisation achieve a greater understanding of these laws, that still, 16 years later, are often misunderstood and baffling to doctors, nurses, care staff and the public in general. My training will provide your staff with the confidence to apply these legal frameworks and explore the issues that must be considered in determining how to assess capacity, when to assess capacity, who can assess capacity and how to record these assessments.
